About these terms

These Terms and conditions govern use of terramax.md and how information, commercial quotes, services or financing options may be requested through the site.

The site is mainly informational and used to request quotes. Sending a form, message or request does not by itself conclude a contract and does not oblige Terramax to sell, deliver, perform a service or obtain finance.

The final commercial terms — including the product or service, price, VAT, payment method, delivery time, warranty and other relevant terms — are those stated in the confirmed quote, invoice, contract or other commercial document accepted by the parties.

Site operator

terramax.md is operated by S.C. “EUROCAR LUX” S.R.L., IDNO 1007600024646, registered office at bd. Mircea cel Bătrîn, 16, ap. 65, Chișinău, MD-2044, Republic of Moldova.

Terramax is the brand under which agricultural machinery, equipment, parts, services and related solutions are presented.

The site and published information

Terramax publishes information about agricultural machinery and other equipment, second-hand machines, parts, services, financing options and other available products or services.

We work to keep information, technical specifications, images and descriptions accurate and up to date. They may still be updated, corrected or changed without prior notice.

Information published on the site is not a firm contractual offer unless this is expressly stated.

New and second-hand machinery

The specifications, configuration, equipment and availability of new machines may vary by manufacturer, model and selected configuration.

For second-hand machines, technical and visual condition, year of manufacture, operating hours, equipment and any defects or signs of use may differ from one unit to another.

Information on the product page is provided for information. Before a transaction, the customer may ask for further details, photographs, documents and, where relevant, to inspect the machine.

The actual condition of the machine and the characteristics that form part of the transaction are those set out in the quote, handover record, invoice or contract between the parties.

Requesting and confirming a quote

Forms on the site are used to send a request for a quote or for information.

Sending a request is not placing a firm order and does not oblige either the customer or Terramax to conclude a transaction.

After a request is received, a Terramax representative may contact the customer to clarify the product, configuration, availability, delivery method, financing or other terms.

A transaction becomes binding only when the commercial terms are accepted by the parties in the form appropriate to that transaction.

Prices and payment

Prices shown on the site, where available, may be indicative and may change until a quote is confirmed.

For each transaction, the commercial quote will state the applicable price, the currency, whether VAT is included or added separately, and any extra costs for transport, installation, commissioning or other services.

The method and timing of payment are set in the quote, invoice or contract for the transaction.

Delivery and handover

Terramax may arrange or facilitate delivery of machinery within the Republic of Moldova and, if agreed, to other destinations.

The time, cost, address and delivery terms are set individually in the quote or contract for the transaction.

Times given before the transaction is confirmed are estimates unless they are expressly stated as guaranteed.

Handover records or other relevant commercial documents may be drawn up on delivery.

Warranty, conformity and complaints

Warranty terms differ by product type, manufacturer, condition and the nature of the transaction. They are communicated to the customer before the transaction is concluded, or in the documents for the product.

For second-hand products, the warranty or any special terms are stated separately when they apply.

Nothing in these Terms limits mandatory consumer rights under the law of the Republic of Moldova.

Service and parts

Information about diagnosis, maintenance, repairs, spare parts and other services on the site is general.

Availability of services and parts, the time to complete the work and the cost are set after the machine is identified and, where needed, after diagnosis.

An estimated time or cost given before diagnosis may be revised if further work, parts or problems are identified.

Financing

Terramax may present information about financing solutions offered by partner financial institutions and may help pass a request to them.

S.C. “EUROCAR LUX” S.R.L. does not grant credit and does not guarantee that financing will be approved, unless expressly stated otherwise.

Eligibility, approval, interest, fees, down payment, term and the other conditions are set by the financial institution under its own criteria and contractual documents.

Personal data

Personal data sent through the site forms, by email, telephone or other channels is processed under the Privacy policy and the applicable personal-data law, including Law no. 195/2024 on personal data protection.

Information on cookies and similar technologies is available in the Cookie policy.

Intellectual property

The texts, structure, graphics, photographs, materials and other original elements of the site are protected by applicable law and may not be reproduced or used for commercial purposes without the right holder’s consent, except where the law allows it.

Marks, names and graphics belonging to manufacturers or partners are the property of their respective owners and are used for identification and presentation.

Acceptable use

The site may not be used to send false information, attempt unauthorised access, interfere with the site, distribute malicious content, or carry out other unlawful or abusive activity.

Terramax may limit access to certain functions in the event of abusive use or attempts to compromise the security of the site.

Limitation of liability

Terramax makes reasonable efforts to keep the information on the site accurate and the online services available.

There may still be drafting errors, differences between presentation images and the actual product, changes to manufacturer specifications, temporary unavailability of products, or technical interruptions of the site.

To the extent permitted by law, Terramax is not liable for commercial decisions made solely on preliminary information on the site, before that information is confirmed in a quote or a contractual document.

This section does not limit rights and liability that cannot be excluded or restricted by law.

Governing law and disputes

These Terms are governed by the law of the Republic of Moldova.

If there is a disagreement, the customer is encouraged to contact Terramax first at contact@terramax.md to try to resolve it directly.

This step does not limit the customer’s right to use the legal means of resolving disputes or, where relevant, the mechanisms available for consumer protection.

Changes to the terms and contact

Terramax may update these Terms from time to time to reflect changes to services, commercial processes or applicable law.

The version published on this page is the current version. The date of the last update is shown at the top of the page.
